Fright of what may occupy the site and rely on the issued CUP in the future is not a defensible finding for denial of this application. Otherwise the Police rep would have offered substantive evidence other than the support he apparently voiced. The City should revise its Code asap and get out of the way of the group. Just my .02
Date: Tuesday March 2nd, 2010 16:52 Comment 205981 E of email: @: ok, fine then. yer answer is here instead- It appears that the problem is not the eating disorder land use proposed but that the City Code language classifies the use as needing a CUP in a too broad category for "Hospital". This broad CUP category would run with the land and could easily be seen as allowing a similar but potentially negatively impacting land use (such as half way house) on the property in the future w/o the need for an additional CUP issuance. The City has options to support the eating disorder use- condition the CUP in some fashion that legally limits the uses or term of use with advice from the City Attorney; change the Code to revise the "Hospital" CUP use to break out less impacting uses into a new CUP category; deny the application as is. I'd be hard pressed to find any evidence that an eating disorder facility is inconsistent with residential zoning. Once again Code gets in the way of a good thing. Then again, when Code is written it is nearly impossible to vision all possible compatibilty and conflict situations. Good luck!
